Terms of Service

By accessing or using Evolasi, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not access or use the platform.

Evolasi is an AI-powered learning and productivity platform designed to help users learn, organize, and accomplish personal and professional goals through Marcus, an AI assistant that supports notes, goals, journaling, learning, and workspace organization.

When you create an Evolasi account, you agree that:

• You will provide accurate, current, and complete information.
• You are responsible for maintaining the security of your login credentials.
• You are responsible for all activity that occurs under your account.
• You will notify us promptly if you suspect any unauthorized access or security breach.

Evolasi currently offers the following subscription plans:

Plan features, pricing, and availability may change as the platform evolves.

Evolasi reserves the right to modify subscription pricing, subscription plans, included features, AI usage allowances, and service offerings from time to time as the platform continues to improve.

Any pricing or subscription changes will apply only to future billing periods and will never affect charges that have already been processed. When reasonably possible, Evolasi will provide advance notice before any material subscription pricing changes become effective.

Marcus and Marcus+ subscriptions include monthly AI usage allowances designed to provide a high-quality experience while maintaining reliable service for all users. AI usage allowances, plan features, and service limits may be adjusted over time as technology, operating costs, and platform capabilities evolve.

Continued use of a subscription after a pricing or subscription update becomes effective constitutes acceptance of the updated subscription terms.

Marcus and Marcus+ subscriptions include monthly AI usage allowances intended to provide a reliable, high-quality experience for all users.

AI usage allowances are designed for normal personal, educational, and professional use. To maintain platform performance and availability for all users, Evolasi reserves the right to apply reasonable usage limits, adjust AI usage allowances, or temporarily restrict access if abnormal, excessive, automated, abusive, or fraudulent usage is detected.

AI usage allowances automatically reset at the beginning of each billing cycle according to the user's active subscription plan.

Users who consistently require additional AI capacity may upgrade to a subscription plan that includes a higher monthly AI usage allowance.

Evolasi reserves the right to modify AI usage allowances, subscription features, workspace limits, and service offerings as the platform evolves.

• Payment information is securely collected when you begin your free trial or subscription.
• The Marcus plan automatically converts to a paid monthly subscription at the end of the 3-day free trial unless you cancel before the trial ends.
• Marcus+ billing begins immediately upon subscription; no free trial is offered.
• Subscription fees are billed automatically each billing period until you cancel.
• We may change pricing with reasonable advance notice for future billing periods.

You may cancel your subscription at any time from your account settings. Cancellation stops future billing and takes effect at the end of your current billing period. Cancellation does not reverse or refund charges that have already been processed.

Evolasi reserves the right to suspend, restrict, or terminate accounts that engage in fraudulent activity, abuse of the platform, attempts to bypass subscription limits, automated exploitation, unauthorized access, or any activity that threatens the security, reliability, or availability of the Evolasi platform.

Subscription fees already paid remain subject to Evolasi's No Refund Policy.

When using Evolasi, you agree that you will not:

• Abuse, misuse, or manipulate Marcus or other AI features.
• Attempt to exploit, attack, probe, or bypass security on the platform.
• Upload, share, or store illegal or infringing content.
• Use Evolasi for any unlawful, harmful, or fraudulent purpose.
• Interfere with other users, the platform, or its underlying services.

By using Evolasi, users acknowledge that conversation history may be securely retained and, when reasonably necessary, reviewed by authorized Evolasi personnel for support, security, safety, abuse prevention, platform improvement, or legal compliance as described in the Privacy Policy. All such administrative access is logged for accountability.

Marcus is an AI assistant. Its responses are generated by machine-learning systems and may be inaccurate, incomplete, or out of date.

• Marcus may make mistakes and should not be treated as an authoritative source.
• You remain fully responsible for your own decisions and actions.
• Marcus is not a substitute for legal, financial, medical, investment, mental-health, or other professional advice.
• Always exercise independent judgment before acting on AI-generated responses.

Evolasi, Marcus, and all related branding, software, content, designs, and platform features are the intellectual property of Evolasi LLC. All rights not expressly granted to you are reserved. You may not copy, modify, distribute, or create derivative works from the platform or its content without prior written permission. You retain ownership of content you create within your own workspaces.

Evolasi is provided on an ongoing basis, but the service may occasionally experience maintenance, updates, outages, performance issues, or changes to features. Planned features (such as Marcus+) may change in scope, pricing, or availability before or after release. We do not guarantee uninterrupted access to the platform.

To the fullest extent permitted by law:

• Evolasi is provided on an "as is" and "as available" basis without warranties of any kind.
• Evolasi LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
• You assume full responsibility for how you use information generated by Marcus and other AI features.
• Our total liability for any claim related to the service will not exceed the amount you paid us in the twelve months preceding the claim, or one hundred dollars if no payment was made.

Evolasi may suspend or terminate any account that violates these Terms, poses a security risk, or engages in fraudulent or illegal activity. You may also close your account at any time from your settings. Provisions of these Terms that by their nature should survive termination will continue to apply.

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict-of-law principles. You agree that any dispute arising out of or related to these Terms or the use of Evolasi will be resolved in the state or federal courts located in Wisconsin.

Evolasi may update these Terms from time to time to reflect new features, business practices, or legal requirements. When we make material changes, we will update the "Last updated" date above and may provide additional notice within the platform. Your continued use of Evolasi after updates take effect constitutes acceptance of the revised Terms.
